Since January 1, 2013, brokers are required to report options trades to the IRS. Like options-trading strategies, the tax treatment of options trades is far from simple.


Under new broker reporting requirements, options transactions are now reported to the Internal Revenue Service when you close the position, including your cost basis and capital gain or loss. Be aware that some options transactions such as straddles, short sales and wash sales require special tax treatment and may result in a reportable capital gain before the position is closed. The IRS began requiring brokers to keep track of cost basis for security trades beginning in 2011 with equity trades. Options trading was added to the requirement on January 1, 2013. Any option trades after that date will have the basis recorded and reported to the IRS on Form 1099-B when those options are sold, including calculated capital gains on the transaction. Capital Gains and Losses. With the new reporting requirements, your broker statement and 1099-B will separate short - and long-term capital gains and losses. Any security held for one year or less results in a short-term capital gain or loss. Anything held over a year allows a more favorable long-term capital gains rate, though the loss is treated identically. If after you combine all gains and losses during the tax year, you have a net loss, you can write off up to $3,000 per year against other income and carry over the remainder to future tax years until you exhaust the excess. Constructive sales are transactions involving an appreciated security such that selling the position would result in a gain if you were to immediately close the position. In-the-money options are one example.


Another is when you hold a stock and buy an option to sell at higher than the current market value -- buying that option represents a constructive sale. You must realize the gain on the date of the constructive sale, and the transaction will be reported to the IRS. When you close the position, only report income net of the gain recognized on the constructive sale. Taxpayer Responsibility. If you sell options purchased before January 1, 2013, the broker may not report the sale to the IRS. However, you are still required to report the transaction when you file your tax return. Report each individual sale of options on Form 8949, using the appropriate part for short - and long-term transactions. Owing to strong trading volumes, a focus on the client and inorganic growth efforts, TD Ameritrade should have positive results in the new year, prompting Zacks Investment Research to reiterate its buy rating on the stock. In a research report issued this week, Zacks said that the prospects for TD Ameritrade Holding Corporation (AMTD) "look encouraging" thanks in part to inorganic activities like its recent acquisition of Scottrade Financial Services. That purchase in October 2016, which valued Scottrade at $4 billion, is expected to bolster the firm's retail business, increase trading operations and expand its branch network by a large amount. On the trading volume front, Zacks said that the Omaha, Nebraska-based discount brokerage has improved on a consistent basis during the past few years. On a year-over-year basis, the daily average trade per client has increased 10% this year. Some analysts have said that TD Ameritrade's move to embrace bitcoin futures, offering the trading product to its clients, could boost the number of customers it has and thus increase its trading volumes in the new year. According to Zacks, the firm's "strong capital position enables it to undertake steady capital deployment activities.


" Zacks noted that, in October of this year, TD Ameritrade raised its quarterly dividend by 17%. "With favorable debtequity ratio compared to the industry's average, these measures look sustainable," wrote Zacks. On the negative side of things, the investment research firm did point to rising operating expenses at the company as something to be concerned about. According to Zacks, the expense base at TD Ameritrade is likely to be under pressure due to ongoing investments in technology and advice. E*TRADE Stock May Have Room to Grow: Zacks. Shares of E*TRADE, the New York-based online brokerage, have been surging all year, up 36% as the stock market continues its bull run unabated. With the stock up 14.2% so far in the current quarter, investors are wondering if there is more room for it to go higher. Zacks Investment Research confirmed the possibility for continued growth in a recent report, highlighting improving operations, a rising interest rate environment and the likelihood that financial companies will face less regulation in the new year. Another positive for E*TRADE Financial Corporation (ETFC) is tax reform, which will slash the corporate tax rate. "This price performance in E*TRADE is backed by the gradually improving operating environment and rate hike scenario which is beneficial for brokerage business," wrote Zacks in its report. "Furthermore, anticipated improvement in trading activities and several ongoing initiatives will bode well for E*TRADE." In October, E*TRADE said that DARTs came in at 215,689, marking a 7% increase from September and a 28% jump year over year. Derivatives accounted for 31% of DARTs during October. In November, the online brokerage said that DARTs increased 19% compared with October, with derivatives again comprising 31% of the total for November. The company said that it added 41,473 gross new brokerage accounts during November and ended the month with about 3.6 million brokerage accounts, which is flat with October. DARTs is a way to measure the performance of a brokerage because it shows investors' willingness to invest in stocks. In addition to increasing DARTs, Zacks said that shares of E*TRADE are "undervalued" on a price-to-book ratio basis. The firm noted that E*TRADE's PB ratio is at 2.16 compared with 3.27 for the average stock on the S&P 500. "Fundamentally, E*TRADE's earnings have surged 29.56% annually over the last three to five years. This impressive earnings growth momentum is anticipated to continue in the near term as well," Zacks wrote.


The investment research firm noted that an increase in interest rates will also bode well for the discount brokerage, given E*TRADE already obtains 60% of its total revenue from net interest income, according to Zacks.
